These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “Customer,” or “you”) and Evolve Softwares LTD., registered in Amsterdam, Netherlands, operating the CheatEvolve platform (“CheatEvolve,” “we,” “us,” or “our”).

These Terms govern your access to and use of:

  • cheatevolve.com;
  • CheatEvolve accounts;
  • CheatEvolve software;
  • software loaders;
  • subscriptions;
  • memberships;
  • licenses;
  • digital products;
  • customer support; and
  • related products and services

(collectively, the “Services”).

By registering an account, purchasing a product, downloading or accessing software, activating a subscription, or otherwise using the Services, you acknowledge that you have read, understood, and agreed to these Terms.

If you do not agree to these Terms, you must not purchase, access, install, download, or use the Services.

1. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction if higher, to purchase paid CheatEvolve Services.

By using the Services, you represent that:

  • you have legal capacity to enter into this agreement;
  • the information you provide is accurate;
  • you are authorized to use the payment method used for purchases;
  • your use of the Services is lawful in your jurisdiction; and
  • your use does not violate contractual obligations applicable to you.

You are responsible for determining whether the purchase, possession, installation, or use of the Services is permitted under laws, regulations, game rules, platform rules, licenses, agreements, and other obligations applicable to you.

2. Nature of CheatEvolve

CheatEvolve is an independent digital software platform operated by Evolve Softwares LTD.

Unless expressly stated otherwise, CheatEvolve is not:

  • affiliated with;
  • sponsored by;
  • approved by;
  • authorized by;
  • associated with; or
  • endorsed by

any video game developer, publisher, platform operator, anti-cheat provider, hardware manufacturer, or third-party company referenced through the Services.

Third-party:

  • game names;
  • company names;
  • trademarks;
  • logos;
  • product names;
  • screenshots; and
  • intellectual property

remain the property of their respective owners.

References to third-party products are provided solely for identification, informational, or compatibility purposes and do not imply affiliation or endorsement.

3. Third-Party Terms and User Responsibility

Certain CheatEvolve products may interact with or alter the behavior of third-party software.

Third-party games, publishers, platforms, servers, competitive services, and anti-cheat providers may prohibit such software under their:

  • Terms of Service;
  • End User License Agreements;
  • community guidelines;
  • competitive rules;
  • server rules; or
  • other policies.

You are solely responsible for reviewing and complying with applicable third-party rules.

CheatEvolve does not control decisions made by:

  • game developers;
  • publishers;
  • platform operators;
  • server administrators;
  • anti-cheat providers; or
  • other third parties.

Your use of CheatEvolve software may result in third-party consequences including:

  • warnings;
  • restrictions;
  • temporary suspensions;
  • permanent account bans;
  • hardware-based restrictions;
  • removal from servers;
  • loss of rankings;
  • loss of virtual items;
  • loss of digital purchases;
  • account termination; or
  • other enforcement actions.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHEATEVOLVE SHALL NOT BE RESPONSIBLE FOR THIRD-PARTY ENFORCEMENT ACTION RESULTING FROM OR RELATED TO YOUR DECISION TO USE THE SERVICES.

4. No Guarantee Against Detection

Software detection status can change at any time.

Anti-cheat technologies, games, drivers, operating systems, security systems, and other third-party software may be modified without prior notice to CheatEvolve.

Any description such as:

  • “undetected”;
  • “currently undetected”;
  • “safe”;
  • “private”;
  • “updated”;
  • “working”; or
  • similar wording

describes CheatEvolve's reasonable understanding of the product's status at or around the time such information is published.

No software is guaranteed to remain undetected indefinitely.

Detection status may change without warning.

To the maximum extent permitted by applicable law, CheatEvolve does not warrant or guarantee that use of any product will prevent:

  • detection;
  • account bans;
  • suspensions;
  • warnings;
  • anti-cheat flags;
  • hardware restrictions;
  • loss of accounts; or
  • other third-party enforcement.

Users voluntarily assume these risks when choosing to use the Services.

5. License

Unless otherwise expressly stated, CheatEvolve grants Customers a:

  • limited;
  • revocable;
  • personal;
  • non-exclusive;
  • non-transferable;
  • non-sublicensable

license to use the purchased product during the applicable subscription or license period.

The software is licensed and not sold.

Purchasing a product does not transfer ownership of:

  • source code;
  • software;
  • loaders;
  • licensing technology;
  • trademarks;
  • infrastructure;
  • databases;
  • intellectual property; or
  • proprietary systems

to the Customer.

6. Prohibited Conduct

Unless expressly authorized in writing by CheatEvolve, Customers must not:

  • share accounts;
  • share licenses;
  • share loader access;
  • share subscription access;
  • resell licenses;
  • sublicense access;
  • redistribute CheatEvolve software;
  • publish CheatEvolve software files;
  • upload CheatEvolve software to file-sharing platforms;
  • leak private releases;
  • reverse engineer CheatEvolve software;
  • decompile CheatEvolve software;
  • disassemble CheatEvolve software;
  • extract proprietary code;
  • attempt to obtain source code;
  • bypass licensing restrictions;
  • circumvent authentication systems;
  • circumvent HWID restrictions;
  • manipulate subscription timers;
  • interfere with CheatEvolve infrastructure;
  • attack CheatEvolve infrastructure;
  • intentionally overload CheatEvolve systems;
  • exploit security vulnerabilities;
  • access accounts without authorization;
  • use stolen payment credentials;
  • engage in payment fraud;
  • commit chargeback fraud;
  • impersonate CheatEvolve personnel; or
  • provide unauthorized access to another person.

Violation of this section may result in immediate suspension or termination of access, subject to mandatory law.

7. Account Security

You are responsible for maintaining the security of:

  • your account;
  • your password;
  • your email account;
  • your computer;
  • your license; and
  • your authentication credentials.

You must not knowingly permit another person to use your account.

You must notify CheatEvolve if you reasonably believe your account or credentials have been compromised.

CheatEvolve may restrict accounts where suspicious access, sharing, fraud, or security threats are detected.

8. HWID and Device Restrictions

Certain CheatEvolve products use hardware-based licensing.

A license may therefore become associated with:

  • a device;
  • specific hardware;
  • a combination of hardware identifiers; or
  • a derived HWID value.

Changes to your computer may result in a HWID mismatch.

Such changes may include:

  • replacing hardware;
  • changing a motherboard;
  • changing certain storage devices;
  • changing system configuration;
  • reinstalling an operating system;
  • modifying virtualization environments;
  • using hardware spoofing tools; or
  • other material configuration changes.

HWID resets may:

  • be limited;
  • require verification;
  • have cooldown periods;
  • be subject to eligibility requirements;
  • require support review; or
  • be refused where CheatEvolve reasonably suspects fraud, account sharing, license sharing, resale, or abuse.

Users are responsible for reviewing applicable HWID requirements before purchasing.

9. Digital Products and Immediate Delivery

CheatEvolve primarily provides digital content and digital services.

A purchase may be considered delivered or performance may begin when CheatEvolve:

  • activates a subscription;
  • activates account permissions;
  • provides loader access;
  • provides a software download;
  • provides a license;
  • activates product access;
  • activates membership privileges; or
  • otherwise makes the purchased digital content or digital service available.

Where applicable law permits the right of withdrawal for digital content to end after performance begins, this shall occur only where all legally required conditions have been satisfied, including any required prior express consent and acknowledgement from the Customer.

Nothing in these Terms eliminates consumer rights that cannot legally be waived.

10. Withdrawal Rights for Digital Content

Consumers located in jurisdictions providing statutory withdrawal rights may have a legal right to withdraw from certain distance contracts.

For digital content that is not supplied on a tangible medium, this right may cease once performance begins where the Customer has:

  1. expressly requested or consented to immediate performance during the withdrawal period;
  2. acknowledged that beginning performance may cause the applicable statutory right of withdrawal to be lost; and
  3. received the confirmation required by applicable law.

Where these conditions have not been legally satisfied, applicable statutory rights remain unaffected.

11. Subscription Periods

The applicable subscription period is shown before purchase.

Unless otherwise expressly stated, subscription time begins once:

  • payment has been confirmed; and
  • purchased access has been activated.

Subscription time may continue to run regardless of whether the Customer actively uses the product.

Customers are responsible for reviewing:

  • product descriptions;
  • subscription duration;
  • product status;
  • system requirements;
  • supported operating systems;
  • hardware requirements; and
  • compatibility requirements

before completing a purchase.

12. Product Updates

CheatEvolve may update, modify, temporarily disable, restrict, replace, or discontinue all or part of a product where reasonably necessary for:

  • security;
  • maintenance;
  • game updates;
  • anti-cheat updates;
  • compatibility;
  • infrastructure changes;
  • third-party changes;
  • legal compliance;
  • fraud prevention;
  • abuse prevention; or
  • technical reasons.

CheatEvolve does not guarantee that every product version will remain available indefinitely.

13. Maintenance and Downtime

Digital products may occasionally become temporarily unavailable due to:

  • maintenance;
  • updates;
  • game patches;
  • anti-cheat changes;
  • server failures;
  • hosting failures;
  • network failures;
  • security incidents;
  • third-party outages;
  • infrastructure changes; or
  • other technical circumstances.

Temporary downtime does not automatically create a right to a refund unless required by mandatory applicable law.

At its discretion, CheatEvolve may compensate Customers for significant downtime by extending subscription time or providing other account credit.

Any voluntary compensation is provided as goodwill and does not establish an obligation to provide identical compensation in future situations.

14. Compatibility

CheatEvolve cannot guarantee compatibility with every possible hardware or software configuration.

Compatibility may be affected by:

  • Windows versions;
  • Windows updates;
  • CPUs;
  • GPUs;
  • motherboards;
  • BIOS versions;
  • drivers;
  • security software;
  • virtualization software;
  • network configurations;
  • third-party applications;
  • game updates; and
  • anti-cheat updates.

Customers are responsible for reviewing compatibility information before purchasing.

15. Security Software and Computer Configuration

Certain software may conflict with:

  • antivirus software;
  • anti-cheat software;
  • Windows security features;
  • drivers;
  • virtualization;
  • firewalls;
  • BIOS settings;
  • Secure Boot;
  • security products; or
  • other applications.

Customers are solely responsible for determining whether to change settings on their devices.

Any change a Customer independently makes to:

  • antivirus protection;
  • Windows Security;
  • BIOS;
  • drivers;
  • Secure Boot;
  • firewalls;
  • virtualization;
  • operating system configuration; or
  • other security functionality

is made at the Customer's own discretion and risk.

To the maximum extent permitted by law, CheatEvolve is not responsible for damage or security consequences caused by a Customer's independent modification of their computer or security configuration.

16. Product Status

Product status pages and labels are provided for informational purposes.

Third-party systems can change without notice.

Accordingly, status information may occasionally become outdated before CheatEvolve has an opportunity to update it.

CheatEvolve does not guarantee that status information represents real-time conditions at every moment.

Customers should review the latest available information before using a product.

17. Pricing

Product prices may change at any time before purchase.

Prices may vary according to:

  • product;
  • subscription duration;
  • currency;
  • region;
  • promotion;
  • payment provider; or
  • applicable taxation requirements.

Changes to pricing will not ordinarily affect transactions already completed.

Customers are responsible for reviewing the final price displayed before authorizing a transaction.

18. Payment Processing

Payments may be handled by independent third-party payment providers.

These providers may independently:

  • authorize transactions;
  • decline transactions;
  • request verification;
  • conduct fraud checks;
  • impose transaction limits;
  • hold transactions;
  • reverse transactions;
  • apply security controls; or
  • restrict payment methods.

CheatEvolve does not control decisions independently made by third-party payment providers.

To the maximum extent permitted by law, CheatEvolve is not responsible for a payment provider's independent decision to decline, delay, hold, or restrict a transaction.

19. Refund Policy

Because CheatEvolve supplies digital products and subscriptions that may become accessible immediately after purchase, refunds are generally not available once access has been activated or digital performance has begun, except where a refund, price reduction, cancellation, termination, or other remedy is required by mandatory applicable law.

Subject to mandatory consumer rights, refunds will generally not be provided solely because:

  • the Customer changed their mind;
  • the Customer did not read the product description;
  • the Customer purchased the wrong product;
  • the Customer purchased the wrong subscription duration;
  • the Customer failed to review system requirements;
  • the Customer's computer is incompatible;
  • the Customer changed computer hardware;
  • a HWID mismatch occurred;
  • the Customer does not know how to configure the computer;
  • antivirus software interferes with the product;
  • another application interferes with the product;
  • a game account receives an enforcement action;
  • a game account is suspended;
  • a game account is banned;
  • hardware is restricted by a third party;
  • a product is detected after purchase;
  • a game update affects functionality;
  • an anti-cheat update affects functionality;
  • the Customer stops using the product;
  • the Customer fails to use remaining subscription time; or
  • the Customer no longer wishes to use the Service.

Nothing in this section eliminates statutory remedies that cannot legally be excluded.

20. Defective or Non-Conforming Digital Content

Nothing in these Terms is intended to eliminate legally mandatory rights relating to digital content or digital services that fail to conform to applicable contractual or statutory requirements.

Where applicable mandatory law provides Customers with remedies such as:

  • bringing digital content into conformity;
  • price reduction;
  • contract termination; or
  • reimbursement,

those rights remain available to the extent legally required.

21. Chargebacks and Payment Disputes

Customers are encouraged to contact CheatEvolve at [info@cheatevolve.com](mailto:info@cheatevolve.com) concerning payment problems before initiating a payment dispute where reasonably possible.

Fraudulent or abusive chargebacks may result in:

  • account suspension;
  • license termination;
  • subscription cancellation;
  • access restriction; and
  • investigation of related accounts.

CheatEvolve may preserve and provide evidence relevant to a payment dispute, including:

  • payment records;
  • IP logs;
  • account records;
  • access records;
  • HWID information;
  • product activation records;
  • authentication information;
  • subscription information; and
  • Customer communications.

Such evidence may be provided to payment providers, acquiring banks, financial institutions, card networks, or dispute-resolution providers where reasonably necessary.

Nothing in this section prevents a Customer from exercising legitimate rights available under applicable consumer or payment laws.

22. Beta, Preview and Experimental Features

Certain features may be designated as:

  • beta;
  • experimental;
  • preview;
  • test;
  • development; or
  • early access.

Such functionality may:

  • contain errors;
  • behave unexpectedly;
  • be incomplete;
  • be modified;
  • become temporarily unavailable; or
  • be discontinued.

Customers use experimental functionality at their own risk, subject to rights that cannot be excluded by law.

23. Support

CheatEvolve may provide support through:

  • its website;
  • email;
  • ticket systems;
  • Discord; or
  • other designated support channels.

Support is provided on a reasonable-efforts basis.

Unless expressly agreed otherwise, CheatEvolve does not guarantee:

  • 24/7 support;
  • a specific response time;
  • resolution within a specific period;
  • resolution of every technical issue; or
  • compatibility with unsupported hardware or software.

24. Suspension and Termination

CheatEvolve may restrict, suspend, or terminate an account or license where it reasonably believes a Customer has:

  • violated these Terms;
  • committed payment fraud;
  • initiated fraudulent chargebacks;
  • shared an account;
  • shared a license;
  • resold access without authorization;
  • redistributed proprietary software;
  • reverse engineered proprietary software;
  • attempted to bypass licensing systems;
  • attacked CheatEvolve infrastructure;
  • compromised CheatEvolve security;
  • exploited vulnerabilities;
  • abused CheatEvolve systems; or
  • created material security, legal, or operational risk.

Where applicable law requires notice, remedy periods, refunds, or other consumer protections, those mandatory requirements remain unaffected.

25. Intellectual Property

Except for third-party materials, CheatEvolve and Evolve Softwares LTD. own or license the intellectual property associated with the Services, including:

  • software;
  • source code;
  • object code;
  • loaders;
  • authentication systems;
  • license systems;
  • website content;
  • website design;
  • graphics;
  • branding;
  • documentation;
  • databases;
  • interfaces; and
  • proprietary technology.

No ownership interest is transferred to Customers.

Unauthorized:

  • copying;
  • redistribution;
  • resale;
  • publication;
  • decompilation;
  • reverse engineering;
  • sublicensing; or
  • commercial exploitation

is prohibited.

26. Third-Party Intellectual Property

All third-party trademarks, names, product names, logos, screenshots, and other intellectual property remain the property of their respective owners.

The inclusion or mention of a third-party brand does not imply:

  • endorsement;
  • sponsorship;
  • authorization;
  • partnership; or
  • affiliation.

CheatEvolve operates independently.

27. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED ON AN:

“AS IS” AND “AS AVAILABLE” BASIS.

TO THE MAXIMUM EXTENT LEGALLY PERMITTED, CHEATEVOLVE DISCLAIMS EXPRESS OR IMPLIED WARRANTIES INCLUDING WARRANTIES OF:

  • MERCHANTABILITY;
  • FITNESS FOR A PARTICULAR PURPOSE;
  • NON-INFRINGEMENT;
  • CONTINUOUS AVAILABILITY;
  • UNINTERRUPTED OPERATION;
  • ERROR-FREE OPERATION;
  • COMPATIBILITY;
  • ACCURACY;
  • SECURITY; and
  • PERFORMANCE.

CHEATEVOLVE DOES NOT GUARANTEE THAT:

  • SOFTWARE WILL ALWAYS FUNCTION;
  • SOFTWARE WILL REMAIN UNDETECTED;
  • A USER WILL NEVER RECEIVE AN ACCOUNT BAN;
  • A USER WILL NEVER RECEIVE A HARDWARE BAN;
  • SOFTWARE WILL FUNCTION AFTER EVERY GAME UPDATE;
  • SOFTWARE WILL FUNCTION AFTER EVERY ANTI-CHEAT UPDATE;
  • SOFTWARE WILL FUNCTION WITH EVERY COMPUTER CONFIGURATION;
  • EVERY SECURITY APPLICATION WILL ACCEPT THE SOFTWARE;
  • THE SERVICES WILL ALWAYS BE AVAILABLE;
  • EVERY TECHNICAL ISSUE CAN BE RESOLVED; OR
  • EVERY PRODUCT WILL REMAIN AVAILABLE INDEFINITELY.

Nothing in this section excludes warranties or statutory rights that cannot lawfully be excluded.

28. Assumption of Risk

You acknowledge that third-party software modifications can involve inherent risks.

By choosing to use the Services, you voluntarily accept risks relating to:

  • third-party account enforcement;
  • detection;
  • account bans;
  • hardware restrictions;
  • loss of access to games;
  • loss of third-party accounts;
  • loss of virtual items;
  • changes in anti-cheat technologies;
  • game updates;
  • operating-system changes;
  • software incompatibility; and
  • modifications you independently make to your computer.

CheatEvolve does not control third-party enforcement decisions.

29. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EVOLVE SOFTWARES LTD., CHEATEVOLVE, AND THEIR OWNERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, REPRESENTATIVES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THE SERVICES.

THIS INCLUDES, TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • LOSS OF PROFITS;
  • LOSS OF REVENUE;
  • LOSS OF BUSINESS;
  • LOSS OF DATA;
  • LOSS OF THIRD-PARTY ACCOUNTS;
  • LOSS OF DIGITAL ITEMS;
  • LOSS OF GAME PROGRESS;
  • LOSS OF RANKINGS;
  • LOSS OF ACCESS;
  • BUSINESS INTERRUPTION;
  • THIRD-PARTY ACCOUNT SUSPENSIONS;
  • THIRD-PARTY ACCOUNT BANS;
  • HARDWARE-BASED RESTRICTIONS; OR
  • THIRD-PARTY ENFORCEMENT ACTION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF EVOLVE SOFTWARES LTD. AND CHEATEVOLVE ARISING FROM A PARTICULAR PRODUCT OR CLAIM SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY THE CUSTOMER TO CHEATEVOLVE FOR THE PRODUCT GIVING RISE TO THE CLAIM DURING THE SIX MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

Some jurisdictions do not permit certain exclusions or limitations.

Accordingly, these limitations apply only to the maximum extent permitted by applicable law.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability that cannot legally be excluded for fraud, intentional misconduct, death or personal injury where applicable, or other mandatory statutory obligations.

30. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Evolve Softwares LTD., CheatEvolve, and their personnel from third-party claims, liabilities, losses, damages, and reasonable costs arising from:

  • your unlawful use of the Services;
  • your violation of these Terms;
  • fraudulent activity performed through your account;
  • unauthorized redistribution of CheatEvolve software;
  • infringement of third-party rights caused by your actions; or
  • intentional misuse of CheatEvolve systems.

This provision applies only to the extent permitted by mandatory applicable law.

31. Force Majeure

To the maximum extent permitted by law, CheatEvolve shall not be responsible for delays, interruption, or failure caused by events reasonably outside its control, including:

  • Internet outages;
  • hosting outages;
  • server outages;
  • cyberattacks;
  • denial-of-service attacks;
  • power failures;
  • payment network failures;
  • infrastructure failures;
  • natural disasters;
  • government restrictions;
  • legal orders;
  • war;
  • civil disturbances;
  • third-party platform changes;
  • game updates;
  • anti-cheat updates; or
  • failures of third-party service providers.

32. Changes to the Services

CheatEvolve may modify or update the Services for:

  • technical;
  • operational;
  • security;
  • compatibility;
  • commercial; or
  • legal reasons.

Where applicable consumer law grants Customers mandatory rights arising from material modifications to ongoing digital services, those rights remain unaffected.

33. Changes to These Terms

CheatEvolve may update these Terms where reasonably necessary.

The current version will be published on our website together with the applicable “Last Updated” date.

Where required by applicable law, Customers will receive appropriate notice before material changes take effect.

A change to these Terms does not retroactively eliminate rights that Customers already have under mandatory applicable law.

34. Severability

If any provision of these Terms is found invalid, illegal, or unenforceable, that provision shall be interpreted or modified to the minimum extent necessary to make it enforceable where legally possible.

If that is not possible, the affected provision shall be severed.

The remaining provisions shall continue in full force.

35. No Waiver

Failure by CheatEvolve to enforce a right or provision does not constitute a permanent waiver of that right or provision.

36. Entire Agreement

These Terms, together with:

  • the Privacy Policy;
  • applicable refund provisions;
  • checkout disclosures;
  • product-specific terms; and
  • policies expressly incorporated by reference

form the agreement governing the relevant Services.

37. Mandatory Consumer Rights

Nothing in these Terms is intended to exclude, restrict, or waive consumer rights that cannot legally be excluded, restricted, or waived.

If mandatory consumer protection legislation conflicts with these Terms, that mandatory legislation shall apply to the extent legally required.

38. Governing Law

These Terms and the contractual relationship between the Customer and Evolve Softwares LTD. shall, to the maximum extent permitted by applicable law, be governed by and interpreted according to the laws of the Netherlands, without regard to conflict-of-law principles.

This choice of law does not deprive consumers of mandatory protections granted to them by laws that apply to them and cannot contractually be excluded.

39. Jurisdiction and Disputes

Subject to mandatory consumer jurisdiction rules, disputes arising from or relating to these Terms, CheatEvolve, or the Services shall be submitted to the competent courts in Amsterdam, Netherlands.

If applicable consumer legislation grants a Customer a mandatory right to bring proceedings before another competent court, including a court in the Customer's place of residence, nothing in these Terms is intended to remove that right.
